June 2010

Consultation on Code of Practice on the Mental Health Act 2001

The Mental Health Commission has started work on developing a Code of Practice on the Mental Health Act 2001. A code of practice on the Act would give guidance on the exercise of functions under the 2001 Act. In other words, it would explain how certain parts of the legislation are best put into practice. 

The Commission completed the first phase of consultation on the code of practice in May 2010. The consultation report containing feedback received is now available.

2008

Code of Practice on Admission, Transfer and Discharge to and from an Approved Centre

The Commission held a written consultation on the “draft code of practice on admission, transfer and discharge to and from an approved centre” between November 2007 and May 2008.

The National Service User Executive also carried out several nationwide focus groups with service users on behalf of the Commission in relation to the draft code between September and October 2008.

Code of Practice for the Guidance of Persons working in Mental Health Services with People with Intellectual Disabilities

The Commission held a consultation between September and December 2008 on the draft code of practice for the guidance of persons working in mental health services with people with intellectual disabilities.

Review of Rules and Code of Practice

The Commission carried out a review of the Rules Governing the Use of Electroconvulsive Therapy, Rules Governing the Use of Seclusion and Mechanical Means of Bodily Restraint, and the Code of Practice on the Use of Physical Restraint in Approved Centres between September and December 2008.
