Registration of Approved Centres - Mental Health Act 2001, Section 64
The Mental Health Act 2001 commenced in full on 1st November 2006. Since that date the Mental Health Commission is responsible for the registration of approved centres.
Part 5 Section 62 of the Mental Health Act 2001 defines the following terms:
- " 'centre' means a hospital or other in-patient facility for the care and treatment of persons suffering from mental illness or mental disorder";
- " 'the register' means the Register of Approved Centres";
- " 'registered proprietor', in relation to a centre, means the person whose name is entered in the register as the person carrying on the centre".
Therefore an approved centre is a centre that is registered by the Commission in accordance with the Mental Health Act 2001. Section 63 provides for the prohibition of unregistered centres.
If you are a person carrying on, or who proposes to carry on a centre you must apply to the Commission for registration in accordance with Section 64 of the Mental Health Act 2001.
